1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Node Works Ltd ("Company", "we", "us"), a company registered in Kenya, governing your access to and use of the Seekr platform at seekrjobs.com (the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Seekr is an AI-powered job search platform that helps users find, evaluate, and apply to job opportunities. The Service includes:

  • Resume parsing and profile creation.
  • AI-powered job matching with transparent scoring breakdowns.
  • Ghost job detection and listing confidence scores.
  • Application readiness analysis.
  • Cover letter generation.
  • Interview preparation materials.
  • Salary intelligence and market insights (Pro plan).
  • Application tracking.

3. Account Registration

To use the Service, you must create an account with a valid email address. You agree to:

  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.

You must be at least 16 years old to create an account and use the Service.

4. Subscription Plans and Billing

4.1 Free Plan

The Free plan provides limited access to core features at no cost, including a capped number of job matches per week and cover letters per month. Feature limits may change at our discretion with reasonable notice.

4.2 Pro Plan

The Pro plan provides full access to all features for a recurring subscription fee. Pricing is displayed on our pricing page and may be updated with 30 days notice to existing subscribers.

4.3 Billing

  • Payments are processed by Paystack. By subscribing, you also agree to Paystack's terms of service.
  • Pro subscriptions include a 30-day free trial. You will not be charged during the trial period.
  • After the trial, your subscription will automatically renew at the applicable rate (monthly or yearly) unless cancelled before the renewal date.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

4.4 Refunds

We offer a 30-day money-back guarantee for Pro plan subscribers. If you are not satisfied within the first 30 days of your paid subscription, contact us for a full refund. Refunds are not available after the 30-day period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Upload malicious files, viruses, or harmful content.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems.
  • Scrape, crawl, or use automated tools to extract data from the Service beyond what is provided through our interface.
  • Resell, redistribute, or commercially exploit the Service or its outputs without our written consent.
  • Use the Service to generate spam applications or submit mass automated job applications.
  • Impersonate another person or entity in your resume or applications.
  • Interfere with or disrupt the Service or overload our infrastructure.

6. Intellectual Property

6.1 Our Content

The Service, including its design, code, features, and branding, is owned by Node Works Ltd and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

6.2 Your Content

You retain ownership of content you upload (resumes, preferences, etc.). By uploading content, you grant us a limited, non-exclusive license to process, store, and analyze it solely for the purpose of providing the Service to you. This license terminates when you delete your account.

6.3 AI-Generated Content

Cover letters, interview prep materials, and other content generated by the Service using AI are provided for your personal use in job applications. You are responsible for reviewing and verifying all AI-generated content before use. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

7. Disclaimers

  • The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • We do not guarantee that you will receive job offers, interviews, or any specific outcomes from using the Service.
  • Job listings are aggregated from third-party sources. We do not verify the accuracy, legitimacy, or availability of every listing (though we provide confidence scores to help you assess them).
  • Match scores, salary intelligence, and readiness assessments are AI-generated estimates and should be used as guidance, not as definitive measures.
  • We are not a recruitment agency and do not act as an employer or intermediary in the hiring process.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Node Works Ltd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from:

  • Your use of or inability to use the Service.
  • Any unauthorized access to or alteration of your data.
  • Content or conduct of third parties on the Service.
  • Reliance on AI-generated content, match scores, or salary estimates.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Node Works Ltd from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Account Termination

  • You may delete your account at any time through your account settings or by contacting us.
  • We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
  • Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes that affect your use of paid features. Continued use of the Service after changes constitutes acceptance of the modifications.

12. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms or the Service shall be resolved through the courts of Kenya, unless otherwise required by applicable law in your jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full effect.
